Expiation for Having Sex During Confinement Period

    What is the kaffarah if a man had a sex with his wife in her postnatal days, i.e. days after the birth of child and not completing her 40 days of confinement?

    Thank you for your question.

    In general the maximum days of postnatal or postpartum bleeding is 40 days.

    It is prohibited to engage in sexual intercourse during the nifas (post-natal) period when the blood has not seized. If the blood has seized and the wife is confident that the bleeding has ended, she must take a bath and resume all obligations such as ritual prayer. In such a state, both husband and wife are permitted to enjoy sexual intimacy and intercourse with no reservation or objection, even if it is before the 40 day mark. If however, the postnatal bleeding did not end, and the couple engage in intercourse, the couple must seek forgiveness from the Almighty. There is no mandatory kaffārah (compensation) in such a scenario other than repentance. Some jurists do suggest giving an amount in charity as a praiseworthy act along with the repentance
