Custody of Children - Can the Father-In-Law Take Custody?

    I lost my husband last year. Is it allowed in Islam for my father in-law to take custody of my kids? Please note that he is separated from my mother in-law and still unmarried, as for my mother in-law old and not strong as a result of an ailment.

    We sympathise with your situation and pray that your husband is rewarded with the best in the hereafter.
    Custody of children in Islam is firstly for biological parents. In your case, the mother has the right to custody. If for some reason the mother consents to giving custody to in-laws, that is permitted.

    The central matter in custody is the best interest of the child. The child should be given a good upbringing and provided care, education, training and nourishment.
